Terms and Conditions

These terms and conditions govern the use of the website including The Volunteering Platform of Livery Schools Link (together called “the Site”). They represent a binding agreement between each user and Livery Schools Link (“LSL”).

By using the Site, you accept and agree to abide by these terms and conditions. If you do not agree to these terms of use, please do not use the Site. You are responsible for ensuring that all persons who access the Site through your internet connection are aware of the terms and conditions, and that they comply with them.

From time to time LSL may revise these terms and conditions, and will post any revision on the Site. You will be deemed to have agreed to any revised terms and conditions when you next use the Site following any revision. We recommend that you read these terms and conditions regularly.

Livery Schools Link is a voluntary, not-for-profit organisation. Our members are certain subscribing City of London livery companies from time to time. We can be contacted through our administrator: info@liveryschoolslink.co.uk

1. The database

The purpose of the database is to facilitate introductions between volunteers in City of London livery companies and schools or organisations involved in education in the Greater London area. It is a means by which schools and organisations may identify prospective volunteers to support activities which help to prepare young people for the world of work, and for members of the Livery to identify such volunteering opportunities.

2. Access and use of data

2.1. Schools, organisations and volunteers will be given access to the database in the sole discretion of LSL.

2.2. If you commit a breach of these terms and conditions, LSL reserves the right in its sole discretion immediately and without notice to suspend or permanently deny your access to all or part of the database. LSL may determine in its sole discretion whether there has been such a breach.

2.3. Where LSL has given you, or where you have chosen a password which enables you to access the database, you are responsible for keeping this password confidential. A volunteer must not share their password with anyone; a school or organisation must not share their password with anyone who is not duly authorised by that school or organisation to use the database. LSL has the right to disable any password, whether chosen by you or allocated by LSL, at any time, if in LSL’s opinion you have failed to comply with any of the provisions of these terms and conditions.

2.4. By entering or uploading any information of other material, you consent to our using them or any part of them to create and print in anonymised form reports on volunteering activities for use by LSL and Livery companies, whether or not they are members of LSL. In doing so, we will not share any of your personal data such as name or contact details.

2.5. LSL will not be liable if for any reason the Site is unavailable at any time or for any period.

3. Subscription and administration charges

LSL reserves the right to charge subscription and/or administrative charges to users in order to access certain features and services on terms described on the Site from time to time.

4. Volunteers, schools, organisations and activities

4.1. LSL makes no representations, warranties or guarantees about:

4.1.1. the accuracy, currency or completeness of any information on the Site or entered or provided by users of the database;

4.1.2. the status or suitability of any volunteer to take part in any activities for a school or organisation;

4.1.3. the status or suitability of any school or other organisation or its representatives which may offer a volunteering opportunity through the Site;

4.1.3. the terms and duration of any volunteering appointment facilitated or obtained through the Site.

4.2. All responsibility for the content of information held in the database lies with the person from whom the information originated. Where LSL’s administrator enters data on behalf of a school, organisation or volunteer, LSL accepts no liability for any error or omission, even if caused negligently.

4.3. LSL does not screen or approve volunteers. It is the sole responsibility of schools or organisations who use the database to satisfy themselves as to the status and suitability of any individual who volunteers through the database, including but not limited to the carrying out of Disclosure and Barring Service (DBS) checks.

4.4. Where a volunteer is selected for any activity, the resulting legal contract, if any, is between the volunteer and the school or organisation, and the relationship will be governed by any terms and conditions that might be agreed between them, including but not limited to any issues as to potential liability and related indemnity insurance.

4.5. LSL is not an agent either for the volunteers or for the schools or organisations.

4.6. LSL does not guarantee that any school or organisation will register any appropriate volunteering opportunities, or that any organisation will interview or recruit any volunteer for such a purpose, or that any suitable volunteer will be available or will meet the needs of any organisation registering volunteering opportunities with it.

4.7. LSL does not guarantee that any school or organisation will keep confidential any information or data obtained by them from the Site.

5. Use of the Site

As a user you will not:

5.1. misrepresent your identity or affiliation with any other person or organisation or otherwise enter or upload any inaccurate, incomplete or false information, including without limitation in the case of volunteers, biographical information about yourself or information about your ability to volunteer;

5.2. use the Site in any other way that is fraudulent, or has any fraudulent purpose or effect;

5.3. use the Site for the purpose of harming or attempting to harm minors in any way;

5.4. use the Site to send junk email or spam to people who do not wish to receive messages from you;

5.5. use the Site to conduct, display or forward surveys, raffles, lotteries, contests, pyramid schemes, chain letters or other activities that are not related to the purpose of the database as defined in paragraph 1 of these terms and conditions;

5.6. interfere with or disrupt LSL’s service or services or knowingly introduce any computer virus or disabling device (including but not limited to any malicious code or instructions), Trojan horse, worm, time-bomb, keystroke logger, spyware, adware or any other harmful programs or similar computer code designed to affect adversely the operation of any computer software or hardware.

5.7. alter or delete any information without due authority to do so;

5.8. use the Site for, or to promote, any unlawful or illegal purpose, or in any way that breaches any applicable local, national or international law or regulation.

6. Content standards

All information and other material entered or uploaded to the Site by you must:

6.1. be accurate, where it states facts;

6.2. state opinion only if it is genuinely held;

6.3. comply with applicable law in the UK and in any country from which it is entered or uploaded;

6.4. not be defamatory to any person, obscene, hateful, offensive, threatening, inflammatory, sexually explicit, or promote violence;

6.5. not promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;

6.6. not infringe any copyright, database right, trade mark or any other intellectual property right of any person;

6.7. not breach of any legal duty owed by you to a third party, such as a contractual duty of confidentiality;

6.8. not give the impression that it emanates from LSL if this is not the case.

LSL has the right to disclose your identity to any third party who claims that information or other material entered or uploaded by you breaches these content standards.

7. Links

Where this Site contains links to external websites, LSL accepts no responsibility for or liability in respect of the content of those sites, nor does it warrant that any links to such sites work or are up to date. The use of any such links is at your own risk.

8. Intellectual property

8.1. LSL is the owner or licensee of all intellectual property rights in respect of the Site, and in the material published on it. All such rights are reserved.

8.2. You may print off copies, and may download extracts, of any page(s) from the Site for your personal reference. You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

8.3. LSL’s status and that of any identified contributors as the authors of material on the Site must always be acknowledged.

8.4. You must not use any part of the materials on the Site for commercial purposes.

9. Exclusion of liability

To the fullest extent permitted by law:

9.1. LSL excludes its liability and that of its employees, officers, committee and administrators, in contract, tort or otherwise, even in the event of its or their negligence, for any direct, indirect, incidental or consequential loss, damage, cost or expense of whatsoever nature, arising in any way out of or in connection with:

9.1.1. incorrect or misleading information on the Site;

9.1.2. the use of or the lack of availability of the Site or its content;

9.1.3. volunteering opportunities offered by or on behalf of any school or other organisation through the Site;

9.1.3. activities undertaken by any volunteer for any school or organisation.

9.2. LSL excludes all conditions, warranties and other terms which might be implied by statute or otherwise into this agreement.

10. Jurisdiction and applicable law

10.1. The agreement between you and us on these terms and conditions shall be governed by and construed in accordance with the law of England and Wales.

10.2. The courts of England will have exclusive jurisdiction over any dispute or claim arising out of or in relation to the use of the Site.

10.3. If any provision of these terms and conditions is held to be invalid by a court of competent jurisdiction, such invalidity shall not affect the validity of the remaining provisions, which shall remain in full force and effect.
